Puppy Contract & Health Guarantee

This agreement is made between Ohio Puppy Paws (“Seller”) and the Buyer(s) listed below (collectively “Buyer”), and is made as in the date hereinafter set forth.

The within-described puppy is guaranteed to be in good health to the best of the Seller’s knowledge at the time of sale. The Seller guarantees all possible steps have been taken with the sire / dam selection and breeding to prevent hereditary issues.

Buyer understands that because Goldendoodle are a crossbreed and are not a “standardized breed” the dog is not guaranteed to hypoallergenic or low shedding; and no guarantee is made regarding size, weight or coat types when grown. Seller has endeavored to make the best match possible between puppy and Buyer.

The Buyer bears all costs relating to the sale of the above animal, including transportation. The risk of loss or injury to the above animal is on the Buyer at all times after the puppy leaves the Seller.


1. Five-Day Wellness Guaranty Period

Seller has instructed the Buyer to have the puppy checked by a licensed veterinarian within five (5) days of purchase. If the veterinarian finds anything that is life threatening with the puppy, it will be exchanged for another puppy of equal gender/color/breed and generation when one is available. The Buyer will provide a written statement from a licensed veterinarian clearly stating the defect or illness.

If the puppy is not taken to a licensed veterinarian within the five days of taking possession the health warranty is void. Common puppy ailments such as giardia, clostridia, coccidia, viral illness, parasites are not covered in this guaranty. This puppy has been examined at approximately 7 weeks of age by Seller’s vet and all common puppy illnesses/issues have been addressed and preventative measures taken.

Any signs of depression, lethargy, lack of appetite or desire to drink water, diarrhea (particularly with mucus and/or blood) vomiting must be reported to the breeder and your vet immediately.


2. Four- Month Puppy Protection Period

Buyer understands that Seller has instructed Buyer not to take puppy to public places (including but not limited to, parks, neighbors, pet supply stores, puppy classes/training, etc.) frequented by other puppies or dogs until the puppy has received it’s final round of shots (16 weeks of age). This is for the health of the puppy and to avoid contact with areas where infected or unvaccinated dogs may have been or may be present with such illness/bacteria/fungus causing parvo, giardia, clostridia, coccidia, etc. might be present. This is to protect the puppy and could save the puppy’s life. Any illness contracted from the Buyer’s decision not to follow these guidelines will void this guaranty.


3. Thirty Six Month Guaranty Period

If the within-described puppy is diagnosed with hip dysplasia or a congenital disorder that is life threatening or greatly diminishes the dog’s quality of life and that is identified within the 24 months from the puppy’s date of birth. Buyer will have the option of receiving a replacement puppy from the next available litter of equal gender/color/breed and generation.

What Is Covered

Seller guarantees your dog for 36 months from the date of birth for:

  • Hip Dysplasia (HD) and /or Elbow Dysplasia (ED). The diagnosis of hip dysplasia (mild, moderate or severe), or an elbow dysphasia rating of Grade 2 or Grade 3. X-rays to be taken by a licensed DVM and submitted to the OFA. Copies of report(s) to be provided to Seller.
  • Eye Disorders. Congenital defect of the eye causing progressive blindness in one or both eyes and/or requiring surgery or ongoing medication, as diagnosed by a Veterinary Ophthalmologist. (Proof to include copies diagnosis and treatment documentation from a Board Certified Veterinary Ophthalmologist).
  • Cardiac (Heart) disorders requiring surgery or a heart disorder requiring life-long medication diagnosed by a Board Certified Canine Cardiologist.
  • Von Willebrand’s Disease (vWD) blood disease. Proof submission to include verification by VenGen using a DNA test for vWD.
  • A hereditary/congenital disorder that is life threatening or greatly diminishes the dog’s quality of life, diagnosis to be verified by a lab or expert with knowledge in the field and proof is submitted to the Seller.
Requirements
  • Buyer must supply any requested records related to the dog’s condition to the seller within seven days of the diagnosis.
  • Seller has the right to require a second opinion from a veterinarian and/or veterinary specialist of the Seller’s choice at the Seller’s expense.
  • If a necropsy is performed and the results in undermined or inconclusive diagnosis, warranty is void.
  • If the puppy is euthanized or in any way disposed of without a second opinion from the Seller’s veterinarian, the Buyer waives all rights to a replacement puppy.
What Is Not Covered

This warranty does not include viral illnesses, infections, improper bites, hernias, cancer or endocrine disorders, hypoglycemia, worms, giardia or coccidiosis. It also does not include any illness due to the ingestion of foreign objects, food, plants, chemicals or other items, physical injury or issues whose cause is unknown or may have been an environmental link or illnesses from unknown causes that are not preventable by genetic pre-screening, including but not limited to, cancerous growths. Not included in this guaranty are health problems arising from trauma, abuse, or failure to maintain general health care of this dog (including allowing this dog to become overweight). Also not included is injury to joints or bones from over-exercise. Veterinary records must be provided to Seller if requesting replacement. Under no circumstances shall the Seller be liable to the Buyer or to any third party for a dog that has been subjected to abuse, accident, negligence or misuse. Also under no circumstances shall the Seller be liable for any consequential incidental or special damages resulting from or in any manner related to this dog. This warranty does not cover any behavioral issues that the Buyer experiences after taking possession of the puppy. Basic obedience training is encouraged within the first year.

Buyer's Responsibility

The Buyer agrees to the following:

  • Feed a quality dog food
  • Maintain the dog in good health, provide routine preventative health care including but not limited to, inoculation, parasite control and preventative medication
  • Not allow the dog to become overweight or over-exercised
  • Never turn dog over to a shelter or rescue
  • Notify Seller if Buyer must re-home the dog
Non-Transferable

This guaranty is not transferable and is between the Seller and the original Buyer only.

Release of Liability

Buyer hear-by forever releases an indemnifies the Seller from any and all claims of liability, whether known or unknown at this time or for which claim may arise after the signing of this Agreement.

No Other Warranties

It is further understood and agreed that no warranty or representation has been made with respect to the described puppy except as set forth herein. Buyer agrees to hold Seller harmless and free from any liability from the time Buyer has taken possession of the puppy.

This guaranty is void if this agreement is not signed and postmarked (either by U.S. postal mail or email) within 10 days of its receipt.

4. If Buyer Can Not Keep the Puppy

If for any reason the puppy Buyer can not keep the puppy it is to be returned to the Seller at Buyers expense and Seller is not obligated to return any of the funds received for the sale of the puppy.

5. Entire Agreement

This Agreement represents the entire Agreement between parties and there are no other agreements, expressed or implied unless included in the Agreement or by writing signed by both parties and made a part hereof. Seller's initials
